2. Why do we process personal data?

This process helps us to check that certain personal, financial and solvency conditions to do business with our partners are fulfilled and to ensure compliance with applicable law and regulations.
   
   In addition, GO2-Markets may process your data to fulfill its obligation of compliance with a legal obligation to which it is subject according to Article 6, paragraph 1, c) GDPR or in order to protect its legitimate interests or those of a third party, according to Article 6, paragraph 1, f) GDPR. In this case, GO2-Markets shall, to the extent possible, notify the Individual of such data processing.

3. Which data are we collecting?

   We might collect personal data from our customers and suppliers for contractual purposes, such as names, email addresses or telephone numbers. We may collect Personal Data in the form of Trackers or Usage Data for advertising communication purposes. These communications are displayed in the form of banners and other advertisements on this website, possibly based on User interests. 1plusX AG uses Trackers to identify Users or they may use the behavioral retargeting technique, i.e. displaying ads tailed to the User’s interests and behavior, including those detected outside of this website. We may also collect Personal Data in the form of session statistics, Trackers and Usage Data for analytical purposes, to enable GO2 Markets to monitor and analyze web traffic and keep track of the visitors behavior. Google Analytics 4 is a web analysis service provided by Google Ireland Limited (“Google”). Google utilizes the Data collected to track and examine the use of this website, or prepare reports on its activities and share them with other Google services. Google may use the Data collected to contextualize and personalize the ads of its own advertising network. In Google Analytics 4, IP addresses are used at collection time and then discarded before Data is logged in any data center or server.    We also use a Customer Relationship Management ("CRM") Tool - Hubspot - to track emails or record calls, improve and manage our sales processes. Calls are only recorded with the express consent of the data subjects.
   
   We use Mailchimp as our marketing platform and collect email addresses, first and last name, Trackers and Usage Data of subscribers to our newsletter. We process these email addresses in order to send news and updates about our company. If further agreed by the data subject, we may use the email address and/or phone number provided to reach out for commercial purposes. If you agreed to join our talent pool, we need to collect your name and a way to reach out to you such as an email address or a phone number.
   
   Finally, we might collect personal data such as names, surnames, IDs or passports, date and place of birth, nationality, email address, phone number and business role when conducting our KYC procedure.

4. Who has access to your personal data and how do we treat it?

   Your personal data might be communicated within the company as well as to our suppliers, brokers or commercial partners in accordance with the purposes stated hereabove. We thrive to share personal data only to the extent absolutely necessary, in accordance with the principle of data minimization.
   
   Your data may also be made available to public administration to ensure the respect of our obligation in accordance with national and European law and regulation.
   
   GO2 Markets thrives to ensure the best protection for your personal data by preventing it from being manipulated, lost or destroyed or accessed by unauthorized persons. The data collected within the EU and the EEA is stored in the EU, save for data transfers to our CRM tool and Mailchimp. Such data transfer is only made where an adequate level of protection for personal data exist, which can rely, without limitation, on Standard Contractual Clauses, the Data Privacy Framework or a similar transfer mechanism providing safeguards and/or binding corporate rules in accordance with the GDPR.
   Data transfers from our CRM and Mailchimp rely on Standard Contractual Clauses.
   
   We do not share your personal data with any third parties not referred to under this Privacy Policy, nor do we sell it or disclose it.

5. How long do we store your personal data?

   Your personal data are stored for the time necessary to achieve the above-mentioned purposes and to comply with legal or regulatory obligations.
   Personal data processed for contractual purposes are stored for ten (10) years from the Termination of the Agreement as an archive to meet tax or accounting obligation.
   Personal data provided to join our talent pool are stored for a period of three (3) years and will be automatically deleted thereafter. You can revoke your consent to the storage of your personal data in the talent pool at any time, in accordance with “§6. Your rights”.

6. Your rights

   You are entitled to:

   • Request a copy of the personal data collected and stored;
   • Exercise your right to rectification to correct any information believed to be inaccurate or incomplete;
   • Request information such as how GO2 Markets collects and uses your personal information and why, the categories of personal information involved, how long GO2 Markets uses or stores your personal information;
   • Ask GO2 Markets to delete or stop using your personal information;
   • Withdraw your consent to the use of your personal information. This will not affect the lawfulness of processing prior to the withdrawal.

   GO2 Markets applies the principle of non-discrimination in respect to personal data. This means that we won’t deny goods or services, charge a different price or provide a different level or quality of good or services just because you exercised your rights under the GDPR and/or CCPA. However, if personal data are necessary to provide you with goods or services, we might not be able to complete that transaction.
