These Terms and Conditions of Use (T&Cs) govern your access to and use of this Website and of the CO2 Analysis software (the "CO2 Analysis") made available on GO2 Markets website for the approximate calculation of climate damaging emissions of a company.
By using this website or signing up to the CO2 Analysis and using the Services, you acknowledge that you have read and understood these T&Cs, are authorized to accept these on behalf of the company you represent and agree to be bound by them. If you don't agree or otherwise cannot comply with these T&Cs, you may not access or use the CO2 Analysis.
GO2 Markets reserves the right to change, modify, add or delete provisions of these T&Cs at any time. The continued use of the CO2 Analysis after the changes constitutes your acceptance of these changes.

GO2 Markets grants to each User a non-exclusive, non-transferable or assignable right to use the CO2 Analysis. GO2 Markets remains the exclusive owner of the software, its content, design and all information Users agree to disclose on the CO2 Analysis.
Information provided on the CO2 Analysis shall only be used by the Users for internal purpose and shall not in any way be publicly disclosed or shared to any Third Party without the prior explicit and written consent of GO2 Markets, unless this information is already lawfully publicly available.
Any reuse, copying and more generally any reproduction, representation or use of any of the CO2 Analysis items, including all software, design, text, editorial materials, informational text, illustration, logo or graphic material, wholly or in part, without GO2 Market's authorization is strictly prohibited and may give rise to a legal action.
The purpose of the CO2 Analysis is to create a tool for the approximate calculation of climate-damaging emissions, in particular CO2 and other greenhouse gases (GHG) of a company.
The CO2 Analysis offers, among other features, the possibility to estimate the emissions of a company based on the data it provides relating to electricity consumption, commuting of employees, business travels, etc.
The CO2 Analysis, including its content, is provided on an "as is" and "as available" basis without any warranties of any kind, and GO2 Markets expressly disclaims any and all warranties, whether express, implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
GO2 Markets does not warrant that the use of the CO2 Analysis will be uninterrupted, timely, secure, error-free or virus-free. GO2 Markets reserves the right to conduct maintenance activities on the CO2 Analysis as well as the right to change, modify, update, delete or add any content to the CO2 Analysis, including but not limited to functionalities, features or design.
No information, advice or services obtained through the CO2 Analysis shall create any warranty not expressly stated in these T&Cs and in no event shall GO2 Markets be liable to any User for any decision made or action taken by the Users relying on the information disclosed on the CO2 Analysis.
The CO2 Analysis has been produced on a best-efforts basis. The conversion factors used in the CO2 Analysis come from a variety of sources including the Intergovernmental Panel on Climate Change (IPCC), the US Environmental Protection Agency (EPA), Department for Environment Food & Rural Affairs (Defra) and the Association of Issuing Bodies (AIB).
Without prejudice to the other obligations set forth in these T&Cs, GO2 Markets hereby warrants that:
GO2 Markets has taken reasonable care to ensure the information is accurate but shall not be held responsible in any manner for any error or omission, any loss of profit, reputation or goodwill, or any other direct, indirect or consequential loss arising from your use of the CO2 Analysis and the Information, files and material contained on the CO2 Analysis; the temporary or permanent inability to use the CO2 Analysis or any interruptions of the functioning of the Platform.
GO2 Markets shall not be liable either for the accuracy of the analysis results of the user’s climate emissions, as these are calculated on the basis of the information and data provided by the user of the CO2 Analyiss, possibly on the basis of average and benchmark data.
The Use of the CO2 Analysis Services requires GO2 Markets to collect and store personal data for the good performance of the CO2 Analysis Services. The collection and use of personal data fully comply with the General Data Protection Regulation ("GDPR") and all the definitions related to personal data contained in these T&Cs shall expressly refer to and be interpreted in accordance with the GDPR.

The collected data are processed solely for the good performance of the CO2 Analysis, including to provide security and reliability of the CO2 Analysis Services, for the operation and administration of the CO2 Analysis, to contact Users, to offer technical support and responding to requests, as well as for the prevention and detection of fraud or criminal offences or to meet obligation required by applicable data protection law provisions.
Such data will be processed electronically and will be stored for a period of two (2) years.

The collected and processed data are obtained with the consent of the individuals concerned according to Article 6, paragraph 1, a) GDPR as well as for pre-contractual and contractual purposes according to Article 6, paragraph 1, b) GDPR.
In addition, GO2 Markets may process your data to fulfill its obligation of compliance with a legal obligation to which it is subject according to Article 6, paragraph 1, c) GDPR or in order to protect its legitimate interests or those of a third party, according to Article 6, paragraph 1, f) GDPR. In this case, GO2 Markets shall, to the extent possible, notify the User of such data processing.

These T&Cs shall be governed by the laws of Germany without regard to the principles of conflicts of law. Unless otherwise elected by GO2 Markets in a particular instance, you hereby expressly agree to submit to the exclusive personal jurisdiction of the federal and state courts of Berlin, Germany for the purpose of resolving any dispute relating to your access to or use of the CO2 Analysis.
